Is it the end of the power struggle over union benefits? Maybe it is just the start

„Dziennik Gazeta Prawna”: When in 2015, the Constitutional Tribunal ruled that the right to unionize applies to all who work “like employees” (even if they do not work on contracts of employment), no one expected that it would be so hard to pass the relevant legislation> Employers have already announced that they will file a complaint to the International Labour Organization over the new regulations.

The biggest issue is the extension of union benefits a.o. to the self-employed.

– We are of the opinion that the changes introduced by the bill will go too far. There are no grounds to extend the rights of employees with regards to specific benefits to the self-employed, a.o. with regards to the right of delegation and employment protection –
explains Monika Gładoch, legal adviser, professor at UKSW and expert of Employers of Poland.
